Terms and Conditions of Services

1. Purpose


These Terms and Conditions of Service (hereinafter the “Terms”) set out the terms and conditions under which Daisy Premium Family (hereinafter “Daisy” or “the Provider”) connects the Client with a candidate service provider for domestic, childcare, or household management services, according to the criteria defined by the Client. These Terms, together with the mandate and quote accepted by the Client, constitute the entire agreement between the parties and serve as the contract between the Client and Daisy Premium Family. They apply to every engagement without reservation or restriction, subject to any special terms agreed in writing between the parties.


2. About Daisy Premium Family


Daisy Premium Family is a premium family concierge dedicated to connecting private households with carefully vetted domestic, childcare, and household management professionals. Our approach is built on discretion, rigour, and genuine care: we take the time to understand each family's needs, apply a considered verification process to every candidate we present, and remain by our Clients' side throughout the placement and beyond.


3. Candidate Experience Levels


Candidates presented by Daisy are classified according to three experience levels:
Experienced: more than 5 years of experience and verified professional references.
Qualified: more than 5 years of experience, professional references, and at least one diploma in early childhood care and/or first aid.
Confirmed: more than 8 years of substantial experience, at least one of the diplomas mentioned above, and recommendations from previous employers.


4. Services Offered


4.1 Domestic Services
Include, in particular: housekeeping, grocery assistance, cooking assistance, cleaning services, pet-sitting (dog walking), laundry services, and senior assistance (personal care, etc.). This list is not exhaustive.


4.2 Child-Related Services
Include, in particular: nanny, tutoring, childcare assistant, after-school transport, and school taxi services.


4.3 Household Management Services
Include, in particular: house manager, butler, valet service, private chauffeur, general household steward, and other household management services.


5. Matching Process


Daisy's service follows the steps below :
Supporting the Client in precisely defining their needs;
Searching for candidates matching the criteria agreed with the Client;
Compiling and verifying candidate files, in accordance with Article 7 of these Terms;
Submitting to the Client the candidate's CV, the information gathered and, upon request, the reference contact details of shortlisted candidates;
Upon the Client's agreement, organising a video-conference interview between the Client and the candidate. Daisy systematically offers to supervise this interview; the Client nonetheless remains free to decline this supervision, in particular for reasons of their own or of a confidential nature. In that case, Daisy cannot be held liable for anything said or disclosed during that interview, given that it was not in a position to attend;
Only once the Client has expressly validated the candidate following that interview may an in-person meeting between the Client and the candidate be arranged, the Client undertaking to keep Daisy informed of how it proceeds and of its outcome;
From the Client's final validation of the candidate onward, the working relationship is established exclusively between the Client and the selected candidate. Daisy's role is then limited to that of a supervising third party, as part of the placement follow-up included in the package subscribed to, and Daisy is not a party to any employment contract, in any capacity whatsoever.


6. Packages and Terms


The placement fees applicable to each package are set out exclusively in the brochure previously provided to the Client, and not in these Terms. This exclusive disclosure through the brochure reflects Daisy's commercial confidentiality policy and shall not be construed as a failure to inform: the Client acknowledges having received and reviewed this brochure prior to signing the mandate.


6.1 Daisy (Experienced profile)
Includes: one complimentary replacement during the first six months, ongoing support throughout the placement, a monthly newsletter, and access to the preferred membership programme.


6.2 Lys (Degree-qualified profile)
Includes: one complimentary replacement during the first six months, complimentary set-up administrative management, ongoing support, a monthly newsletter, a year-end gift, and access to the preferred membership programme.


6.3 Iris (Confirmed profile — Daisy Ultra)
Includes: one complimentary replacement during the first sixteen months, complimentary set-up administrative management and support during the first three months, ongoing support, a dedicated private customer service, a monthly newsletter, a contract-anniversary gift, a year-end gift, exclusive discounts and benefits with Daisy's hotel, restaurant, and wellness partners, a privileged introduction to Daisy's curated international network of partners, and access to the preferred membership programme.

6.4 Dahlia (Confirmed profile — Daisy Ultra)
Includes: the same benefits as the Iris package, plus complimentary access, for an initial renewable six-month period, to Daisy's Preferred Membership Programme which offer, without limitation, acces to a full portfolio of concierge services (domestic staff, gardeners, pet care specialists, and other household professionals), and a dedicated private customer service available 24/7.
 

6.5 Daisy Preferred Membership Programme.

Daisy Premium Family offers a quarterly or semi-annual membership, providing unlimited access to the full range of household and domestic services available through our concierge.
In addition, members benefit from exclusive access to our prestigious international network of legal, tax advisory, and real estate experts, including one complimentary consultation or audit, automatically and systematically included with the membership.
Members also enjoy access to a curated selection of complimentary gifts and exclusive services, including fine dining experiences, massage treatments, spa experiences, luxury hotel stays at renowned establishments, as well as privileged access to exclusive events, private galas and soirées, high-end sports and leisure clubs, and much more.
The membership fee is communicated confidentially through the brochure provided beforehand.

 

7. Responsibility of Daisy Premium Family


7.1 Obligation of Means and Search Timelines
Daisy acts as a matching intermediary and undertakes an obligation of means, not of result. This obligation of means is reflected, in particular, in the following search timelines, running from validation of the mandate: forty (40) days for the Daisy package, thirty (30) days for the Lys package, and twenty (20) days for the Iris package.
Beyond this timeline, Daisy continues the search until a candidate matching the agreed criteria is found, unless the Client, once informed that the timeline has been exceeded, expressly requests that the search be stopped. In that case, the Client is entitled to a full exoneration of search fees, under the conditions set out in Article 10.


7.2 Candidate Verification
Prior to any presentation, Daisy verifies the following elements only:
a clean criminal record extract for the candidate;
an up-to-date CV, the accuracy of which is declared by the candidate under their sole responsibility;
the validity of the professional references provided by the candidate (verified contact details).
This verification does not extend to any other element, in particular medical, psychological, financial, or physical-fitness related, and the Client acknowledges that it is their responsibility to conduct any further interview or check they deem useful before finally validating the candidate. This limitation of liability applies in particular, without limitation, to the case referred to in Article 5 where the Client has declined Daisy's supervision of the video-conference interview.

7.3 Allocation of Responsibility After Candidate Validation
From the Client's final validation of the candidate, the Client becomes the sole employer of the selected candidate, who becomes their sole employee. In that capacity, the Client alone bears responsibility for any damage, loss, theft, injury, or other harm arising in the course of the employment relationship, as would any private employer. The Client is accordingly advised to take out private-employer liability insurance covering this type of risk.
Daisy's liability may only be partially engaged, after the candidate has been validated, where the candidate demonstrates negligence endangering the life, home, or property of the Client or of persons connected to the Client, or fails in their duty of professionalism, insofar as Daisy presented and recommended that candidate.
For the purposes of these Terms, “negligence” means the candidate's failure to exercise a degree of care or caution ordinarily expected in the performance of their duties, causing or reasonably likely to cause harm to the Client's person or property. 
“Failure in the duty of professionalism” means the candidate's breach of an essential obligation of their role, as set out in their employment contract with the Client (in particular punctuality, compliance with instructions, confidentiality, or conduct), provided that such breach is established and objectively evidenced.

8. Administrative Management


8.1 Scope of the Service
Administrative management, included in certain packages or available separately as a monthly subscription with no commitment, includes:
initial administrative set-up: drafting the employment contract, creating accounts on the relevant declaration platforms, registering the contract with the competent state authorities, and personalised advice;
monthly declarations: declaring hours worked, managing declarations with the competent authorities, and follow-up and verification;
issuing and securely transmitting monthly payslips, and archiving the related documents;
issuing and transmitting the annual tax statement, with support for deducting eligible expenses;
tax support: assistance completing the relevant tax return and advice on optimising deductions;
legal support and assistance: access to Daisy's team of legal professionals and its partner law firm, with answers and advice tailored to the Client's questions.
This service does not, under any circumstances, constitute Daisy assuming the Client's employer obligations, which remain entirely the Client's responsibility as the sole employer of the selected candidate under Article 7.3.


8.2 Point of Contact and Referral to Third Parties
Daisy remains the Client's primary point of contact for any question relating to administrative management. Where circumstances require it, Daisy reserves the right to refer the request to its legal, tax, and administrative partners, and to contact the competent state services if necessary.
Daisy applies its confidentiality clause (Article 13) to any request made to its partner providers. Where a situation requires sharing the Client's personal information with a third party, Daisy undertakes to obtain the Client's express written consent before any such disclosure.


9. Payment Terms
No deposit is required upon signing the mandate. The search begins as soon as the mandate is signed, and these Terms apply automatically from that same signature; the Client pays only once the process has concluded, under the conditions below.


The invoice is sent to the Client as soon as the Client has finally validated the candidate. Payment is due within seven (7) business days of the invoice being issued.
After this period, a surcharge of 5% of the invoice amount is applied per day of delay, provided that the total surcharge may never exceed 50% of the total mandate amount. For example, for a mandate of CHF 400, the cumulative surcharge will never exceed CHF 200, regardless of the number of days of delay: the 50% cap is reached after ten days of delay (5% × 10 days) and does not increase beyond that point.
Payments are made exclusively through the payment link provided by Daisy, with payment processing handled by Stripe. Any other payment link received that was not issued by Stripe must be treated as fraudulent and reported to Daisy immediately.
After the extended payment period has elapsed, Daisy reserves the right to engage debt-collection services and to initiate any appropriate legal proceedings. Daisy also reserves the right to terminate the contractual relationship in the event of repeated delays, abuse, or breach of the agreed terms.


10. Fee Exoneration Policy


10.1 Sole Case of Exoneration
The mandate entered into with Daisy is exclusive: the Client undertakes to rely solely on Daisy for the search for, and introduction to, a candidate matching their request, for the entire duration of the mandate.
The only case in which the Client is entitled to a fee exoneration is where the search timeline applicable to their package (Article 7.1) has been exceeded and the Client has not validated any candidate for a valid reason within the meaning of Article 10.2. The fact that the Client conducts a parallel search through other means and, as a result, does not select any candidate presented by Daisy, does not constitute a valid reason entitling the Client to a full exoneration of fees.


10.2 Valid Reasons for Declining a Candidate
The following are, in particular, considered valid reasons for the Client to decline a candidate:
the candidate lives more than 35 km from the Client's home;
the candidate does not have the experience corresponding to the selected package;
the candidate does not speak the language required by the Client;
the candidate's references cannot be reached by the Client, or do not match the candidate's statements;
the candidate does not hold a work authorisation in the Client's country of residence;
the candidate is not punctual;
the candidate is not responsive.
A reason based solely on a lack of “personal fit”, without further objective justification, is accepted as a valid reason up to a maximum of two occurrences across the entire matching process. It must in all cases be explained by the Client, so as to allow Daisy, on the one hand, to take the feedback into account in adjusting future introductions and, on the other hand, to assess its validity.


10.3 Unjustified Refusals
In the event of three unjustified refusals within the meaning of Article 10.2, Daisy reserves the right to terminate the mandate, without this entitling the Client to any fee exoneration.


11. Limitation of Liability and Compensation Cap
Except in the case of gross misconduct, Daisy's liability, within the limits set out in Article 7.3, for all damages combined, shall not exceed the price of the relevant mandate increased by a maximum of 20%.
Gross misconduct excluding this cap includes, in particular: death, hospitalisation, or any endangerment directly resulting in the death or hospitalisation of a person, arising from negligence or a failure of the candidate within the meaning of Article 7.3.
This limitation applies without prejudice to any mandatory statutory provisions that could not be excluded under these Terms, in particular where the Client acts as a consumer under the applicable law.


12. Professional Liability Insurance
Daisy Premium Family is covered by professional indemnity insurance & legal expenses insurance taken out with Jove & Allianz UK , covering all of the concierge activities described in these Terms.


13. Confidentiality and Data Protection
Daisy places the utmost importance on the confidentiality of the information shared with it. By signing the mandate and accepting these Terms, the Client automatically benefits from the protection afforded by Daisy's professional and ethical secrecy. This confidentiality covers, in particular:
the Client's first and last name;
their postal addresses;
their landline and mobile phone numbers;
their email address;
their age, date and place of birth;
their profession and employer;
any private information about the Client (for example, the first names of their children, their school, or their age);
any information shared as part of the matching process (selection criteria, any reasons for declining a candidate, the course of exchanges, interview feedback, etc.);
any data and information relating to the employee shared during the period of employment following their hiring by the Client, for the entire duration of the employment contract as well as for the eighteen (18) months following its end.
This 18-month confidentiality period applicable to data relating to the employee may be lifted in the event of professional negligence, a failure in the employee's duties, or endangerment of the life of the Client or those close to them, within the meaning of the definitions set out in Article 7.3, in particular for the purpose of asserting Daisy's or the Client's rights before any competent authority.
Personal data collected by Daisy is otherwise processed in accordance with applicable data protection regulations (in particular the General Data Protection Regulation for Clients located in the European Union, and any equivalent regulation applicable locally). The Client and candidates have a right of access, rectification, objection, and deletion of their data, which they may exercise by contacting Daisy at member@mydaisyfamily.com.


14. Non-Solicitation and Non-Poaching
It is specified that Daisy never hires, in any capacity, the candidates it presents: they remain exclusively employed by the Client, in accordance with Article 7.3. The Client undertakes not to hire, directly or indirectly, outside the scope of the mandate entered into with Daisy, a candidate presented by Daisy for a period of [12 to 24 months to be confirmed] from the date of presentation, except with Daisy's prior written consent. Any breach of this obligation shall entitle Daisy to a lump-sum penalty from the Client equivalent to [amount or percentage to be defined] of the total cost of the relevant mandate.


15. Proof of Consent — Electronic Signature
The Client accepts these Terms by ticking the boxes provided for that purpose when validating their mandate, where applicable via the Dropbox Sign electronic signature solution. This act constitutes firm and final acceptance of these Terms and serves as the electronic signature of the mandate within the meaning of the applicable regulations on electronic evidence. Daisy retains technical proof of this acceptance (timestamp, session identifier) for as long as necessary for evidentiary purposes.


16. Right of Withdrawal
Where the Client acts as a consumer and applicable regulations grant a right of withdrawal for a contract concluded at a distance, that right may be exercised within the statutory period from validation of the mandate, under the conditions set out in those regulations. The Client acknowledges that, if they expressly ask Daisy to begin performing the service before that period expires, they waive their right of withdrawal once the service has been fully performed before the end of that period, or agree to pay an amount proportionate to the service already provided in the event of withdrawal while performance is under way. The Client further acknowledges that, upon conclusion of the mandate and unless a statutory withdrawal period applies, the full amount of the mandate shall become contractually due in consideration of the matchmaking and introduction process undertaken by Daisy, subject to any specific exemption conditions set out in Article 10.


17. Severability
If any provision of these Terms is held void, unlawful, or unenforceable by a competent court, that provision shall be deemed not written and shall not affect the validity of the remaining provisions, which shall continue to have full effect.


18. Entire Agreement
These Terms, together with the quote and mandate accepted by the Client, constitute the entire agreement between the parties and supersede any prior oral or written agreement, exchange, or undertaking relating to the same subject matter.


19. Amendment of the Terms
Daisy reserves the right to amend these Terms. Such updates take place, as a rule, twice a year, in September and January, in line with the two annual back-to-school periods. Any amendment is brought to Clients' attention by appropriate means and applies to mandates entered into after it takes effect; ongoing mandates remain governed by the version of the Terms accepted by the Client at signature, unless mandatory law provides otherwise.


20. Force Majeure
Daisy cannot be held liable for any delay or failure to perform its obligations resulting from an event of force majeure, understood as any external, unforeseeable, and irresistible event, within the meaning given by applicable case law, that makes normal performance of the service impossible.


21. Complaints and Mediation
Any complaint may be sent to Daisy at member@mydaisyfamily.com. In the event of a dispute that cannot be resolved amicably, for France Customer only, the consumer Client may refer the matter free of charge to the consumer mediator designated by Daisy:  CM2C - +33 (0) 1 89 47 00 14 - 49  rue de Ponthieu 75008 Paris, France. For Clients other than consumer residing in France, any complaint or dispute relating to the Services shall be submitted to the Compagny in writting. The Company and the Client agree to use their best efforts and act in good faith to reach an amicable resolution of any dispute arising out of or in connection with the interpretation, performance, or termination of the Services. If no amicable resolution is reached within ten (10) business days, each party shall be free to pursue any available legal remedy before the competent courts, in accordance with these Terms and Conditions of Service. 


22. Subcontracting
Daisy may engage independent third parties (partner agencies or independent providers) for all or part of the search or verification operations described in these Terms, without this affecting Daisy's commitments to the Client under these Terms.


23. Governing Law and Jurisdiction
These Terms are governed by the law of the country of the Client's (private employer's) domicile at the date the mandate is signed. Any dispute relating to their interpretation or performance falls within the exclusive jurisdiction of the courts of the Client's place of domicile, subject to any mandatory statutory provisions requiring a different jurisdiction. Failing an amicable resolution between the parties, the dispute shall be submitted to the competent court determined in accordance with the above.


24. Special Offers
Daisy may occasionally offer special promotions. As part of these offers, only the financial terms of the offer (the amount owed by the Client) may differ from these Terms. All other provisions of these Terms, in particular those relating to the matching process, liability, confidentiality, and fee exoneration, remain fully applicable without change.
The ‘’Summer/Fall” offer, available from 1 June to 31 October is exclusively on the Daisy, Lys and Iris packages.


25. Acceptance of the Terms
The Client expressly accepts these Terms, sent via the Dropbox Sign platform, by ticking the boxes provided for that purpose, and confirms their exclusive commitment to Daisy for the candidate search, under the conditions described in Article 10.1. The Client acknowledges that, apart from the situations mentioned in these Terms, no other circumstance entitles them to a full exoneration of fees once the statutory withdrawal period, where applicable, has expired.
